Terms of Service

Welcome to Pictures by Kim Photography, a photography service provided by Kimberly Frascone (the “Photographer”). By booking the Photographer’s services, you (the “Client”) agree to be bound by the following terms and conditions:

  1. Services: The Photographer provides photography services to Clients for a variety of events, including weddings, family portraits, and more. All services are subject to availability and the Photographer reserves the right to refuse service to any individual or event.
  2. Fees and Payment: Clients are responsible for paying all fees associated with the Photographer’s services, including session fees and any additional fees for prints, digital images, or other products. Payment is due at the time of service, unless otherwise agreed upon by the Photographer.
  3. Cancellation and Rescheduling: Clients may cancel or reschedule their photography session with the Photographer, provided that they provide notice to the Photographer within a reasonable timeframe. In the event of a cancellation or rescheduling, the Photographer may retain any fees paid by the Client.
  4. Intellectual Property: All photographs and images taken by the Photographer are the intellectual property of the Photographer and may not be used, reproduced, or distributed without the Photographer’s express written consent.
  5. Data Protection and Privacy: The Photographer is committed to protecting the privacy and personal data of Clients in accordance with applicable laws, including the General Data Protection Regulation (GDPR). The Photographer collects and processes personal data for the purpose of providing photography services and communicating with Clients about their sessions. The Photographer may also use personal data for marketing and promotional purposes, with the consent of the Client. The Photographer does not sell or disclose personal data to third parties without the Client’s consent, except as required by law.
  6. Liability: The Photographer is not responsible for any loss or damage to Client’s property, including but not limited to cameras, equipment, or other personal items. Clients assume all liability for themselves and any individuals involved in their photography session.
  7. Governing Law: These Terms of Service will be governed by and construed in accordance with the laws of the state of Virginia, without giving effect to any principles of conflicts of law.
  8. Amendments: The Photographer may amend these Terms of Service at any time by posting the amended terms on their website. Client’s continued use of the Photographer’s services after the posting of the amended terms will constitute their acceptance of the amended terms.

By booking the Photographer’s services, the Client acknowledges that they have read and understood these terms and conditions, as well as the Photographer’s privacy policy, and agree to be bound by them. These terms and conditions cannot be varied in any way by the Client unless such conditions are expressly agreed by the Photographer in writing.
